Art Studio by Brainchild is a creative-generation service operated through activ8.digital.

Eligibility and accounts

• You must be legally able to enter a binding agreement where you live.
• Users under 18 require valid permission from a parent or legal guardian.
• Provide accurate account information and keep your credentials secure.
• You are responsible for activity performed through your account.
• Notify us promptly if you suspect unauthorized access.

Google sign-in

Google sign-in is optional and uses Google-provided identity data to authenticate and create your account.

Your use of Google services remains subject to Google's applicable terms and policies.

Disconnecting Google may prevent access unless another sign-in method is linked first.

Our Privacy Policy explains exactly how Google account data is accessed, used, stored, shared, and deleted.

The service

Art Studio by Brainchild provides prompt assistance, image generation, video generation, media delivery, account credits, and billing tools.

Features, models, rates, limits, and availability may change as the service and third-party providers evolve.

Material pricing changes apply prospectively and will be shown before a new purchase or renewal where required.

AI inputs and generated content

• You retain your rights in prompts and uploaded content you lawfully provide.
• You grant us permission to process that content solely to operate, secure, and improve the requested service.
• We may send inputs and settings to disclosed AI providers to create your requested output.
• Subject to applicable law and third-party rights, you may use your generated outputs.
• AI outputs may be inaccurate, unexpected, non-unique, or similar to content created for others.
• We do not guarantee copyright protection, exclusivity, factual accuracy, or fitness for a particular purpose.

Review every output before publishing or relying on it, especially for legal, medical, financial, or safety decisions.

Acceptable use

You must not use Art Studio by Brainchild to:

• violate laws, regulations, court orders, or third-party rights;
• create sexual content involving minors or exploit children in any way;
• create non-consensual intimate imagery, harassment, threats, or targeted abuse;
• impersonate, defraud, deceive, or misrepresent generated content as authentic evidence;
• upload confidential, personal, biometric, or copyrighted material without necessary rights and permissions;
• distribute malware, bypass safeguards, probe security, scrape the service, or disrupt other users;
• resell access, automate abusive usage, or circumvent credits and rate limits; or
• use outputs where human review is legally or professionally required without that review.

We may block content, suspend access, preserve evidence, or report conduct where reasonably required.

Payments, subscriptions, and credits

• Stripe processes purchases using the price, currency, tax, and renewal terms shown at checkout.
• Paid subscriptions renew automatically until canceled through the billing portal.
• Cancellation normally applies at the end of the current paid period unless law requires otherwise.
• Account deletion cancels active subscriptions as part of the deletion process.
• Credits are service units, not money, property, or transferable stored value.
• Purchased and subscription credits currently accumulate without expiry while the account remains open.
• A confirmed failed generation restores the charged service credits automatically.

Except where required by law or stated at purchase, completed purchases and consumed credits are non-refundable.

Contact us promptly about duplicate charges, billing errors, or unauthorized transactions.

Intellectual property

Art Studio by Brainchild software, branding, interfaces, and documentation are protected by applicable intellectual-property laws.

These Terms do not transfer our service marks, code, designs, or provider technology to you.

The repository's open-source license governs covered source code separately from these service Terms.

Availability and third parties

AI, hosting, payment, email, storage, database, and identity providers support portions of the service.

Provider outages, moderation decisions, model changes, or network conditions may delay or prevent a request.

We may change, pause, or discontinue functionality where reasonably necessary, subject to applicable consumer law.

Suspension and termination

You may stop using the service or delete your account through Settings.

We may limit or suspend access for abuse, security risk, nonpayment, legal requirements, or material Terms violations.

Provisions concerning payments, intellectual property, disclaimers, liability, and disputes survive where their nature requires.

Disclaimers

The service is provided on an “as available” basis to the extent permitted by law.

We do not promise uninterrupted operation, permanent media availability, or that every prompt will produce an acceptable output.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive losses.

Our aggregate liability is limited to amounts you paid for the service during the preceding twelve months.

These limits do not apply where liability cannot legally be limited or excluded.

Changes and disputes

We may update these Terms prospectively when the service, law, or our operating practices change.

Material changes will receive reasonable notice. Continued use after effectiveness means you accept the updated Terms.

Applicable law governs without removing mandatory consumer protections available where you live.
